The appointment of Health and Safety Representatives in South Africa is governed by Section 17 of the Occupational Health and Safety Act, 1993 (Act 85 of 1993). The Act requires employers with more than 20 employees at a workplace to designate Health and Safety Representatives in writing for that workplace, or for different sections of the workplace where appropriate.
Before Health and Safety Representatives are appointed, the employer must consult with employee representatives, or where none exist, with the employees themselves, regarding the nomination or election process, the period of office and the designation of representatives. This ensures that Health and Safety Representatives are fairly selected and are able to effectively represent the workforce.
The Act also specifies the minimum number of representatives required. Shops and offices must appoint at least one Health and Safety Representative for every 100 employees or part thereof, while all other workplaces must appoint at least one representative for every 50 employees or part thereof. An Inspector from the Department of Employment and Labour may require additional representatives where the nature of the work, workplace hazards or operational risks justify it.
Health and Safety Representatives must be full-time employees who are familiar with the activities and conditions of the workplace or section they represent. Employers are also required to provide the training, assistance and resources reasonably necessary for representatives to carry out their duties effectively.
