The Occupational Health and Safety Act 85 of 1993 places duties on employers to provide and maintain a working environment that is safe and without risk to the health of employees. Failing to meet applicable health and safety requirements can expose a business to enforcement action, operational disruption and potential legal consequences.
An Occupational Health and Safety inspector may inspect a workplace to assess compliance with the OHS Act, applicable regulations and workplace health and safety requirements. Inspectors have powers to examine workplace conditions, request relevant documentation and take enforcement action where non-compliance is identified.
Where an inspector identifies a dangerous condition or activity that presents a threat to health or safety, a prohibition notice may be issued to prohibit specific work, processes, machinery, equipment or workplace activities. A prohibition can take effect immediately and remains in place until the relevant safety concerns have been addressed.
Where an inspector identifies non-compliance with an applicable regulation, a contravention notice may be issued requiring the employer to address the identified contravention within the period specified. Businesses should take these notices seriously and ensure that corrective action is implemented within the required timeframe.
Where existing health and safety measures do not adequately protect employees, an inspector may direct an employer to take specified steps to achieve compliance. These directions may require improvements to workplace conditions, systems, controls or other health and safety measures.
Being prepared is better than trying to correct compliance problems after an inspection.
SafetySolve helps businesses identify workplace hazards, review OHS compliance gaps, improve health and safety documentation and implement practical corrective actions before problems become more serious.
